Getting started

How do I start working with ProudLegal?

Call or WhatsApp us, email info@proudlegal.in, or use the contact form with a short note on your matter. We will tell you which documents to send and set up a consultation.

What should I bring to the first consultation?

Any notice, order, agreement, FIR, certificate or correspondence connected with the matter, plus your ID. A short timeline of events in your own words also helps a great deal.

Can I consult you without visiting the office?

Yes. Consultations can be held by phone or video call, and documents can be shared by email or WhatsApp.

Do you handle matters outside Punjab?

Yes. We serve clients across India. Online filings can be made from anywhere, and court work in other cities is handled by our advocates or by counsel we work with, with your consent.

Can a family member contact you on my behalf?

Yes, for the initial discussion. For filings and court work we need your own instructions, signatures and identity documents.

Do you take urgent matters?

Yes. If you have an arrest risk, a hearing or a filing deadline in the next few days, tell us at the start so we can prioritise it.

Fees and payment

How are your fees decided?

By the type of work, its complexity and the stages involved. We quote a fixed, stage-wise or retainer fee in writing before starting.

Are government fees included in your quote?

They are listed in the quote but shown separately, because they are paid at actuals to the government, court or registry.

Do I pay the full fee upfront?

For fixed-fee work, usually yes or in two parts. For litigation, fees are generally payable stage by stage.

Do you charge a percentage of what I recover?

No. Advocates in India are not permitted to charge fees linked to the result of a case, so our fees do not depend on the outcome.

Will I get an invoice?

Yes. Every payment is acknowledged with an invoice or receipt.

What if the matter needs more work than quoted?

We tell you before doing additional work and confirm the extra fee in writing. You decide whether to proceed.

Court cases

How long will my court case take?

It depends on the court, the type of case and how strongly the other side contests it. We give you a realistic range at the start and update it as the case moves.

Do I need to attend every hearing?

Usually not. Your advocate attends routine dates; you need to attend when the court requires your presence, such as for evidence or statements.

Can my case be heard online?

Many courts allow hearings by video conference for some matters, and filings are increasingly electronic. Whether it applies depends on the court and the stage.

Can I settle my case after it is filed?

Yes. Most civil and family cases, and compoundable criminal cases, can be settled at any stage, and courts refer suitable cases to mediation.

Can I change my lawyer in the middle of a case?

Yes. The new advocate files a fresh vakalatnama, usually with a no-objection from the earlier advocate, and takes over the file.

What happens if I lose?

Most orders can be appealed or challenged within a fixed time. We explain the options and deadlines as soon as the order is received.

Registrations and licences

How long does it take to register a company?

Usually one to three weeks once documents are complete, depending on name approval and the type of company.

Which documents are needed for most registrations?

PAN and Aadhaar of the owners or directors, proof of the business address, photographs and, for companies, details of capital and shareholding.

Can I register a business at my home address?

In most cases yes, with a utility bill and the owner's no-objection. Some licences, such as drug and food licences, have premises requirements.

Do I need GST registration for a new business?

Only once turnover crosses the threshold, or immediately for certain businesses such as inter-state suppliers of goods and sellers on e-commerce platforms.

Will you remind me about renewals?

Yes. When we complete a registration or licence, we note the renewal and annual filing dates and can track them for you.

Trademarks and copyright

Should I file a trademark before launching my brand?

Yes. A search and filing before you spend on packaging and marketing is the cheapest way to avoid a later dispute.

What does the TM symbol mean?

It shows that you claim the mark as your trademark. The R symbol can be used only after registration.

Can two businesses have the same name?

They can if they operate in unrelated goods or services and there is no likelihood of confusion, but well-known marks get wider protection.

Who owns a logo designed by a freelancer?

The designer owns the copyright unless it is assigned in writing. Always take a written assignment when you pay for a logo or creative work.

Can I file a trademark for a business that has not started yet?

Yes, on a proposed-to-be-used basis, which secures your filing date before launch.

Compliance

What filings does a small private limited company have every year?

At a minimum, board meetings, an annual general meeting, financial statements and annual return with the ROC, an income tax return, and DIR-3 KYC for directors, plus GST and TDS returns if applicable.

What is the penalty for late GST returns?

A late fee for each day of delay, subject to caps, plus interest on tax paid late. Continued non-filing can lead to cancellation of the registration.

Can I close a company that has no business?

Yes, by applying to the Registrar for strike-off once liabilities are cleared and pending filings are completed, or by winding up where needed.

Do proprietorships have to file anything every year?

An income tax return, and GST and TDS returns if registered. There are no ROC filings for proprietorships.

Can you sort out years of missed filings?

Yes. We file the pending returns with applicable fees, use any government relief schemes that are open, and then put you on a regular calendar.
